Information provided on this Site is for personal non-commercial use.  You must have parental or guardian approval to access and use this Site if you are not 18 years of age or over.  When using this Site you must not, and you must not attempt to, interfere with any security related features of this Site, any functions of this Site, modify the content of this Site, disrupt or otherwise interfere with this Site or the equipment supporting and hosting this Site, including servers and the network, or use the Site for data gathering, including by use of robots, screen scraping or other data mining tools or data extraction tools. 

Information on the Site

We endeavour to be as accurate as possible in the information provided on this Site.  While care has been taken in providing information on this Site, including information about products and product descriptions, to the extent permissible by law Price Attack, its employees, related parties, directors, officers, agents, contractors and collaborators do not warrant the accuracy or completeness of the information provided and do not accept liability, including for any loss or damage, that results from reliance on information provided on this Site.

Intellectual Property Rights

All trademarks, including logos and brand names, photographs, video, text, information, look and feel, images, music, sounds, audio, designs, data compilations and software, and other materials used on this Site are protected by trademark, copyright and intellectual property law in Australia.

Unless otherwise indicated reproduction of any part of this Site is unlawful.  Unless otherwise indicated Price Attack trademarks, copyright material and other material protected by copyright may only be reproduced with the written consent of Price Attack.  Where reproduction is permitted that reproduction may only be used for personal non-commercial purposes.

Hyperlinks, Third Party Content and Advertising

This Site may contain hyperlinks to third party content and websites, third party content, paid advertising and other material derived from third parties (“Third Party Content”).  The presence of Third Party Content on the Site, for example infomration pertaining to zipPay and other product information, or hyperlinks to Third Party Content is not to be taken as a recommendation, endorsement or approval of the Third Party Content by Price Attack, its employees, related parties, directors, officers, agents, contractors and collaborators.  Price Attack, its employees, related parties, directors, officers, agents, contractors and collaborators do not warrant the accuracy or completeness of any Third Party Content and does not warrant a third party website is free of viruses or malware.  Any complaint relating to Third Party Content accessed through a hyperlink on this Site should be directed to the third party website containing the Third Party Content.

In relation to this Site you consent to us using and gathering data using cookies, which you may be able to disable through your browser.

Pricing

Prices for products on the Site are in Australian Dollars and include GST.  Unless otherwise indicated all charges are in Australian Dollars.

Prices may vary between Price Attack online, stores, regions and states and may not have sold at the RRP.

Your Account

If you have an account on the Site you are responsible for the confidentiality of your account information and password, and for securing your computer. You are also responsible for ensuring the information is current and correct.

If you are using an account on the Site that is not your account you represent and warrant to us that you have authority to use that account and to legally bind the account holder to these Terms and Conditions and, to the extent you do not have authority to use the account, you assume all liability under these Terms and Conditions.

Placing an Order

Products may only be purchased for non-commercial use, with the exception of purchases made using ‘Trade’.

When placing an order you agree to follow the instructions and read any terms attaching to the placing of that order.

Orders may only be placed on the Site by persons who are 18 years of age or over. If you are not 18 years of age or over must have parental or guardian approval to place an order on the Site and parents and guardians must read and consent to these Terms and Conditions.

We reserve the right to decline fulfilling an order for any reason. In the event your order is declined any amount paid by you in respect of that order will be refunded to you.

Credit Checks

By placing an order with us you consent to us conducting credit checks and to receive or convey information about you from and to third parties, including credit reporting bodies.

Gift Cards

Gifts cards may not be used to place an order on this Site.

Use of Product

When you place an order for a product on this Site you agree to use the product only for the purpose intended and in accordance with the instructions provided by the manufacturer.

Delivery

If orders are place separately they cannot be consolidated into a single order and you will be liable to pay the delivery amount attached to each separate order.

If products are to be delivered to a person other than you, you undertake to obtain consent to give their personal details to us.

If any details provided by you to us are incomplete, incorrect or not current, to the full extent permitted by law, we will not be liable to you or a third party for a failure or delay in processing an order.

We use various freight companies (Delivery Company) to deliver the order.

We do not ship to PO Boxes. All parcels must be delivered to an address other than a PO Box.

You acknowledge and agree that, to the fullest extent permitted by law, we are not liable for any delays in delivery or damage to the products during transit, including direct or indirect loss, consequential loss, including damages for loss of profits, punitive and loss of opportunity.

You acknowledge and agree that it is your responsibility to take delivery of the order promptly during the delivery time of the Delivery Company.If you are not available to take delivery the Delivery Company may leave instructions on where to pick up the order or attempt to re-deliver the order at their sole discretion.You acknowledge and agree that the order may be returned to us if you do not take delivery or collect your order as instructed by the Delivery Company and that you may be charged an additional delivery fee for re-delivery of the order.

In the event an order is returned to us undelivered we may charge a fee for re-delivery.

In the event we are unable to deliver the order to the address instructed we will inform you, cancel the order and refund the cost of the order to you.

In the event that we genuinely provide you with the incorrect product please contact us within 48 hours of receiving the product at info@priceattack.com.au or call us on 07 3215 6000. We will provide you with information on the process for the supply of incorrect goods and you will be provided with the correct product without further charge.

You acknowledge and agree that, the fullest extent permitted by law, on delivery of the order risk in the product transfers to you.

Cancellation

If your product is not available we will contact you, cancel the order and return to you any money paid in respect of that product.

Once an order is placed the order cannot be cancelled.

Returns Policy

We do not offer an exchange or refund for change of mind.

Refunds cannot be offered on items that are discontinued or in a clearance sale.

If a product is faulty or defective please contact us as soon as practicable at info@priceattack.com.au and we will provide you with information about our return process, which may involve sending photos, other information and the product to us.  If we determine the product is faulty or has a defect we will either provide you with a new product or refund price of product. If we determine that the product is not faulty or does not have a defect we will return the product to you.  For the purpose of clarity a product is not faulty or defective due to fair wear and tear.

All refunds will be made using the original payment method.

Click And Collect

Your order may be available to be picked up at a Price Attack store and if so you may select click and collect when you place your order. If an order is to be collected by a person other than you, you undertake to obtain consent to give their personal details to us. We will notify you when your order is ready to be collected. When collecting your order, you must provide your order confirmation and photo identification so staff can verify you are the purchaser (or a person nominated by the purchaser). If requested, you must allow staff to take a copy of your identification for fraud and security purposes.

We reserve the right to decline collection of your product if you cannot or will not satisfy the requirements set out above.

Hairpoints Terms and Conditions

1. General

1. Hairpoints is Price Attack’s rewards program.
2. These terms and conditions (Terms) set out the conditions on which the Hairpoints rewards program is made available to members.
3. These Terms, together with the App terms and conditions govern your membership, and we recommend that you read both carefully before becoming a member.
4. If you join Hairpoints, you agree and consent to receiving communications from us via email, SMS, mail and push notifications (unless you have opted out), including for the purposes outlined in Price Attack’s Privacy Policy.
5. Any reference to Price Attack, We, Us or Our in these Terms, means Brabus PA Franchising Pty Ltd.

2. Who can join Hairpoints?

1. You must be an Australian resident to join Hairpoints.
2. If you are under the age of 18, you must have your parent or guardian’s approval to become a member of Hairpoints and your parent or guardian must read these Terms.

3. Joining Hairpoints

1. To join Hairpoints, you can either:
1. download the Hairpoints App and create an account; or
2. create an account in-store.
2. Joining is free and there are no fees associated with your membership.

4. Hairpoints Levels

1. Although Hairpoints is a free membership program, members have the opportunity to reach different levels of membership, with different benefits.
2. The different Hairpoints levels include Hairpoints Level 1 and Hairpoints Level 2 (each a Hairpoints Level).
3. We reserve the right to vary a Hairpoints Level or add new Hairpoints Levels in our absolute discretion.
4. You can reach higher a Hairpoints Level by accruing and redeeming Points.
5. The accumulation of points for the purpose of your Hairpoints Level is calculated on a 12-month basis. To start with, the 12 months commences on the day that you join.  Once you earn enough points to reach a higher Hairpoints Level, the 12-month period resets. 
6. The below table sets out the number of points you need to earn in a 12 month period to reach each Hairpoints Level:

Hairpoints Level 2	500 points or more

1. If you reach a higher Hairpoints Level, you must earn at least the number of Points in the table above to maintain that Hairpoints Level for the next 12 month period or your membership will be downgraded.
2. If your Hairpoints Level is due to be upgraded or downgraded, it will occur on the next business day after you reach or fail to reach the required number of points.

5. Accruing Points and Eligible purchase

5.1 Eligible Purchases

1. You must make an eligible purchase to accrue points (Points). An eligible purchase is any purchase of products or services by you from any of our Price Attack stores and salons, excluding:
   1. gift cards;
   2. redemption of Vouchers (refer to clause 7); and
   3. booking fees or surcharges paid when you book a service, (Eligible Purchase).
2. For clarity, any purchase made on Price Attack’s online store will not constitute an Eligible Purchase.
3. You must tell us that you are a Hairpoints member prior to completing your Eligible Purchase to ensure that you receive Points for the purchase. You can do this by:
1. providing your Hairpoints membership card which is contained within the Hairpoints App; or
2. providing a requested personal identifier (i.e. your name, phone number or email address) to the team member processing your transaction.
4. The dollar value assigned to an Eligible Purchase is in Australian dollars (AUD) and includes goods and services tax.
5. Any goods returned to Price Attack for a refund are no longer deemed to be an Eligible Purchase, and the corresponding Points will be deducted from the member’s Points balance.

5.2 Accruing Points

1. Your Points accrue in a variety of ways, including:1 point per dollar spent on an Eligible Purchase;
1. 25 points for joining Hairpoints;
2. 25 points for upgrading from Level 1 to Level 2;
3. 50 points for referring a new Hairpoints member; and
4. Bonus points from time to time as announced by Price Attack, as a Flexible Benefit.
5. Points are valid and counted towards your Hairpoints Level for twelve (12) months from the date they were added to your account (i.e. if you earned 50 points on 4 September 2025, the points will expire on 4 September 2026) (Hairpoints Year).
6. Your Points balance includes all Eligible Purchases during your Hairpoints Year and is updated overnight each night.

6. Hairpoints Benefits

1. You will be offered certain rewards, gifts, benefits and/or offers selected by Price Attack (Benefits) as part of Hairpoints, depending on your Hairpoints Level.
2. Due to the nature of the different categories of Benefits, some categories and the corresponding benefits will remain the same throughout each year (Fixed Benefits) and some will change (Flexible Benefits).
3. Benefits will only be available to you in Australia.
4. Fixed Benefits are different for each Hairpoints Level, and include:

1. The Flexible Benefits offered to members at each Hairpoints Level will be published on the Hairpoints App. Please ensure that you check the Hairpoints App from time to time so you know what Benefits may be available to you.  Flexible benefits may include:
1. Competitions open to Hairpoints Members only;
2. VIP access to sales;
3. VIP access to events (online/in store); and
4. Opportunities to earn bonus points.
2. If we make changes to your Fixed Benefits, we will provide advance notice of at least 30 days. This means you will have a period of time to redeem any Benefits currently available to you before this change takes effect. 

7. Vouchers

1. If you receive a Benefit in the form of a voucher, it can be redeemed in any Price Attack store.
2. Once a Voucher is issued to your account, the Points used for that Voucher will no longer be eligible to claim any further Benefits but will be used for the purposes of determining your Hairpoints Level in the relevant Hairpoints Year.
3. You must present the voucher in store for redemption.
4. Any vouchers issued as a Benefit, are not:
1. legal tender;
2. account cards;
3. credit or debit cards;
4. securities;
5. reloadable; or
6. redeemable for cash or other gift cards.
5. The redemption of vouchers will not be an Eligible Purchase and will not accrue Points.
6. Vouchers are valid for 60 days from date of issue.
7. Vouchers can be used in multiple transactions. This means vouchers can be used, prior to the expiry date, until the balance reaches zero.
8. The dollar value on vouchers includes GST.
9. A voucher may be used in combination with other vouchers, gift cards or cash to complete a purchase.
10. Goods that are purchased solely, or in part with a voucher may be exchanged or returned subject to Price Attack’s returns and exchanges policy.

8.  Redeeming other Benefits

1. Benefits are not transferable and cannot be redeemed for cash or equivalent.
2. Each Benefit will be available for redemption during a certain period determined by us acting reasonably (Benefit Redemption Period). We will notify you of the Benefit Redemption Period and you must redeem the Benefit within this period or it will be forfeited. Unless otherwise notified by us, each Benefit may only be redeemed once.
3. All Benefits offered by Price Attack for each Hairpoints Level are offered on a calendar year basis. Depending on your Hairpoints anniversary date, you may not receive all Benefits available during the calendar year for a specific Hairpoints Level. The timing of any Benefits offered by Price Attack will be determined in Price Attack’s absolute discretion.
4. At the start of each Benefit Redemption Period, we will notify you of the Benefit you may redeem either by email (if you are opted in to receive email communications from us) or you may ask one of our store hosts what Benefit you are entitled to. Hairpoints members who have opted out of receiving our email communications will not be notified of Benefits by email but are still eligible to redeem Benefits.
5. Subject to clause 8(f) below:
1. upon changing to a different Hairpoints Level, any Benefits of the new Hairpoints Level replace, and do not merge with, any Benefits of the previous Hairpoints Level; and
2. any Benefit you are entitled to redeem will depend on your Hairpoints Level on the first day of the Benefit Redemption Period.
6. Subject to the specific terms and conditions relating to a particular Benefit, if, during a Benefit Redemption Period, your Hairpoints Level changes, you may redeem the relevant Benefit, as follows:
1. if your Hairpoints Level has been adjusted to a lower Hairpoints Level, you may redeem the Benefit associated with the higher Hairpoints Level; or
2. if your Hairpoints Level is upgraded, and you have not redeemed the Benefit at the time of the upgrade, we may permit you to redeem the Benefit for the higher Hairpoints Level.
7. Any Benefit that you are entitled to as a Hairpoints member may be subject to specific terms and conditions such as Benefit Redemption Period expiry dates, which will be communicated to you at the time of Benefit notification.
8. Although Benefits will usually be available for redemption in our Price Attack Stores, sometimes we may send you your Benefits directly. If you redeem a Benefit at a Price Attack Store, in addition to providing your Hairpoints member details, you will also be required to provide any other redemption information that we require from time to time. For example, you may need to present a voucher that we send you.
9. All Benefits are subject to availability. In this regard and to the extent permitted at law, Price Attack is not liable for Benefits not being available.

9. Hair Health Consultations

1. All Hairpoints members are entitled use to a hair health consultation service at any Price Attack store, as a Benefit of their membership.
2. This is a walk-in service that is subject to availability.
3. Price Attack is not liable for this Benefit not being available in all stores at all times or liable to you for any services that are conducted in store after the consultation.

10. Level 2 Salon Services

1. This clause is only applicable to Hairpoints members who have attained Level 2 status.
2. To redeem the complimentary salon wash and blow dry, you must make an appointment with your preferred salon, subject to availability.
3. Price Attack is not liable for this Benefit not being available in all stores at all times or liable to you for the services conducted in store.

11.  Restrictions that apply to your Hairpoints membership

1. You can only have one Hairpoints membership and you cannot transfer your membership or your Points to anyone else. This means that you also cannot accept anyone else’s Points.
2. Points have no cash or monetary value and cannot be taken or redeemed as cash or equivalent. Benefits cannot be exchanged for other Price Attack products or services.
3. If you think you have more than one Hairpoints membership, please call our Customer Service team on (07) 3215 6000 or use the “Contact Us” page on the Price Attack website or Hairpoints App.
4. If you do have more than one membership, we reserve the right to merge those memberships for you, regardless of whether you have requested this.

12. Your Hairpoints account details

1. You agree you are responsible for:
1. maintaining the confidentiality of your Hairpoints Account details, including any username and password;
2. restricting third party access to your Hairpoints Account via your devices;
3. providing and maintaining current, accurate, complete and truthful information in connection with your Hairpoints Account, including all Hairpoints Account details; and
4. all activities that occur under your Hairpoints Account.

13. Changes to your details or communications preferences

1. You need to tell us if you want to make any changes to your details or if you want to update or customise your communications preferences.
2. You can make changes to your details by logging into your account on the Hairpoints App, talking to one of our team members in-store or contacting our customer care team. If you speak to one of our team members, you must also provide acceptable identifiable information to change your membership details.
3. You can opt out, update or customise your communications preferences by:
1. clicking the unsubscribe link contained in promotional emails;
2. replying STOP to SMS messages; or
3. contacting our customer care team here.
4. If you select not to receive any communications from us at all, you will not be notified of any Benefits by email. You will still be able to ask in-store about Benefits you may be entitled to.
5. Price Attack is not responsible if you don’t notify us of any changes to your details or any changes you make to your communications preferences, which may result in you not obtaining any Benefit or the loss or downgrade of your Hairpoints Level.

14. Terminating your membership

1. If you would like to terminate your Hairpoints membership you can do this by talking to one of our team members in-store or calling our Customer Service team on (07) 3215 6000.
2. We are entitled, if we reasonably determine to do so, to terminate your Hairpoints membership by providing you with at least 30 days’ notice.
3. We may also terminate your membership without notice if we reasonably believe you have breached these Terms.
4. If your Hairpoints membership is terminated, you will no longer be entitled to accrue any Hairpoints Points or redeem any Benefits.

15. Changes to these Terms

1. We keep these Terms on the Hairpoints App and the Price Attack website, so it is easy for you to access them.
2. We try not to change these Terms too often, but sometimes we need to, for example, if the law changes. When we change these Terms, we will put the updated version on the Hairpoints App and the Price Attack website and update the date set out above. If the change is significant, we will provide you prior notice.
3. If you continue to use your Hairpoints membership after we change these Terms, you will be deemed to have accepted the changed Terms. If you do not agree to the changes, you may terminate your Hairpoints membership at any time as set out in clause 14.

1. If you have any questions, or if you have any concerns or a complaint about Hairpoints or your membership, please contact us by talking to one of our team members in any Price Attack store, calling our customer service team on (07) 3215 6000, or using the “Contact Us” page on the Price Attack website.

17. Applicable law

• These Terms are governed by the law of Queensland. You agree to submit to the exclusive jurisdiction of the courts exercising jurisdiction in Queensland. 

18. No waiver and severability

1. Any failure to enforce any of our rights does not constitute a waiver of those rights.
2. Any part of these Terms that is illegal, void or unenforceable may be severed and the remainder will continue in force.
